Advantage Benefits Plus collects nonpublic business, financial and personal information about you and your employees in order to meet our commitment to provide the administrative services you request. This policy applies to all information we have collected or you have provided in order for us to meet your administrative service needs.
Advantage Benefits Plus exercises reasonable care to protect your data from loss, misuse, unauthorized disclosure or access and destruction. Advantage Benefits Plus does not disclose any nonpublic business, financial, or personal information concerning our customers or former customers, except as requested by you or as required by law. Advantage Benefits Plus does not sell to any third parties any of your or your employees’ nonpublic business, financial or personal information.
Advantage Benefits Plus retains participant personal data and health information only for as long as necessary to fulfill our administrative obligations, service your accounts, and comply with federal laws.
Data Retention Practices
FSA, HRA, and HSA Claim Records: Retained for 7 years following the close of the applicable tax year.
Enrollment and Plan Election Data: Kept for 8 years from the end of the specific plan year.
HSA Account Tax Documentation: Stored for 7 years after the final tax reporting form is issued.
General Account Profile Data: Maintained as long as your employer utilizes our administration services.
Data Deletion and Right to Erasure
You may request the deletion of your personal data; however, our ability to delete information is limited by federal regulatory mandates.
Statutory Overrides: We cannot delete active account data, transaction histories, or medical receipts requested under state laws (like CCPA/CPRA) because federal tax and benefits laws supersede state deletion rights.
Purging Process: Once a retention period expires, data is permanently destroyed using secure electronic purging and physical shredding methods.
Employer Terminations: If your employer terminates our administrative agreement, your data transitions to inactive status and is purged according to our standard 7-to-8-year schedules.
Advantage Benefits Plus restricts access to nonpublic personal information concerning our customers and former customers. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.
With respect to account information collected online, such information is accessible only through the use of strong passwords with minimum length, mixed case, numbers, symbols, no repetition, and lockdown after failed attempts as well as multi-factor authentication. To protect the confidentiality of personal information, you must keep your password confidential and not disclose it to any other person.
Any information collected on Advantage Benefits Plus’ website is located on a secured server behind worldclass firewalls with intrusion protection/detection, data leakage protection and IP blocking by geography codes. Our service provider is SSAE 16 SOC 1 Type 2, Payment Card Industry Data Security Standard Level 1 and HIPAA certified. Advantage Benefits Plus’ web application utilizes the latest Secure Sockets Layer (“SSL”) software, which encrypts information you input.
This Privacy Policy may be supplemented or amended by privacy notices ("Privacy Notices") provided at the time we collect specific personal information. In addition, we reserve the right, at our discretion, to make changes to this Privacy Policy at any time.
The level of notice we will provide when we change this Privacy Policy will depend on the nature of the change. We will notify you of any material changes to this Privacy Policy by sending you advance notice. Material changes to this Privacy Policy will be effective as of the effective date included in the notice to you or, if no effective date is included, 30 days after we send the notice to you. Your continued use of Advantage Benefits Plus’ services will constitute your acceptance of the change in terms to the Privacy Policy.
